1. Introduction
Sahfar IT Tech Solutions Pvt Ltd (“Sahfar,” “we,” “us,” or “our”) is committed to delivering high-quality digital services to clients across India and internationally. This Refund Policy explains the terms and conditions under which payments made for our services may or may not be eligible for a refund. By engaging our services, placing an order, or making a payment to Sahfar, you (“Client,” “you,” or “your”) agree to the terms outlined below.
We encourage all clients to read this policy carefully before making any payment or advance, as it forms a binding part of our Terms and Conditions.
2. Our Services
This Refund Policy applies to all services offered by Sahfar, including but not limited to:
- Application Development
- Digital Marketing
- Search Engine Optimization (SEO)
- Social Media Marketing
- Logo & Graphic Design
- Email Marketing
- Data Analytics
- Cyber Security
- Advertisement & Commercial Video Production
- Content Writing
- Banner & Pamphlet Designing
- Brand Development
3. General Refund Policy — No Refund After Work Commences
Once an order is confirmed and the working process has begun, no refund will be allocated under any circumstances.
This means:
- As soon as Sahfar allocates resources, initiates research, design, development, strategy planning, campaign setup, or any other project-related activity following order confirmation, the amount paid becomes non-refundable.
- This applies irrespective of the payment stage — whether it is an advance, partial payment, or full payment.
- This policy applies uniformly to all clients, whether based in India or internationally, and regardless of the service category selected.
We adopt this policy because our services are effort-based, time-based, and resource-intensive from the moment work begins, including but not limited to manpower allocation, third-party tool subscriptions, ad spend, content creation, and design work.
3.1 Before Work Commences
A refund request may only be considered if:
- The client cancels the order before any work, planning, research, or resource allocation has started on Sahfar’s end; and
- The cancellation request is submitted in writing via email to info@sahfar.in within a reasonable period, generally not exceeding 48 hours from order confirmation, unless otherwise agreed in the service agreement or invoice.
Even in such cases, applicable transaction charges, payment gateway fees, and administrative charges (if any) may be deducted from the refunded amount.
3.2 Non-Refundable Circumstances
Refunds will not be issued under any of the following conditions, including but not limited to:
- Work has already commenced, in whole or in part.
- The client changes their mind after project initiation.
- Delays caused by the client in providing necessary information, access, content, approvals, or materials.
- Dissatisfaction with subjective creative outputs (e.g., design style, ad creatives, content tone) that were delivered as per the agreed brief and are subsequently revised under the applicable revision policy.
- Third-party costs already incurred on the client’s behalf, such as domain registration, hosting, software licenses, advertising spend (Google Ads, Meta Ads, etc.), stock media, or paid tools.
- Non-performance guarantees related to SEO rankings, social media growth, or marketing outcomes (see Section 6 below).
- Cancellation after final deliverables have been shared, approved, or published.
- Breach of the service agreement, Terms and Conditions, or misuse of deliverables by the client.
4. Service-Specific Considerations
4.1 Application Development
Once development sprints, coding, UI/UX design, or server/database setup have begun, the project is considered “in process,” and payments become non-refundable. Milestone-based payments already invoiced for completed milestones are non-refundable.
4.2 Digital Marketing, SEO & Social Media Marketing
Once a strategy is created, campaigns are set up, ad accounts are configured, or content calendars are prepared, the service is considered active. SEO and marketing services are performance-oriented but do not guarantee specific rankings, traffic, or conversion results (see Section 6), and therefore are non-refundable once work begins.
4.3 Logo & Graphic Design / Banner & Pamphlet Designing
Once design concepts are created and shared (even in draft form), the service is deemed initiated. Revisions are handled as per the agreed revision policy in your service agreement, not through refunds.
4.4 Email Marketing
Once email templates, automation flows, or campaign lists are set up, the service is considered active and non-refundable.
4.5 Data Analytics
Once data collection, dashboard configuration, or analysis has commenced, the engagement is non-refundable.
4.6 Cyber Security
Once audits, vulnerability assessments, or security implementations have started, fees become non-refundable due to the specialized time and tools invested.
4.7 Advertisement & Commercial Video Production
Once pre-production (scripting, storyboarding, scheduling), shooting, or editing has commenced, payments are non-refundable. Costs for crew, equipment, location, and talent already incurred are strictly non-refundable.
4.8 Content Writing
Once research or drafting has started for the requested content, the service is considered initiated and non-refundable.
4.9 Brand Development
Once brand strategy, positioning, or identity work has begun, payments become non-refundable, given the consultative and customized nature of this service.
5. Payment Terms Related to Refunds
- All projects typically require an advance payment before work begins, as specified in your invoice or service agreement.
- Advance payments confirm your order and authorize Sahfar to commence work; therefore, advance payments are subject to the “No Refund After Work Commences” policy in Section 3.
- Full and final payments are due as per the agreed milestones or upon project completion, prior to the handover of final deliverables, source files, or intellectual property.
- Sahfar reserves the right to pause or withhold deliverables in case of pending, delayed, or disputed payments.
6. No Guarantee of Marketing or SEO Performance
Clients acknowledge and agree that:
- SEO, Digital Marketing, and Social Media Marketing results depend on multiple external factors, including search engine algorithm changes, market competition, platform policies, and client-side cooperation, which are beyond Sahfar’s control.
- Sahfar does not guarantee specific rankings, traffic volumes, lead numbers, follower counts, engagement rates, or return on investment (ROI).
- Non-achievement of specific performance metrics does not constitute grounds for a refund, provided the agreed scope of work has been delivered in good faith and as per industry-standard practices.
7. Cancellations by Sahfar
In the rare event that Sahfar is unable to commence or continue a project due to internal reasons (and not due to any act, omission, or delay caused by the client), Sahfar may, at its sole discretion, offer:
- A full or partial refund of the unutilized advance amount, after deducting costs already incurred; or
- A credit note applicable towards future services with Sahfar.
This clause does not apply to cases where the project has been paused or delayed due to client-side reasons.
8. How to Request a Refund (Where Applicable)
If you believe you qualify for a refund under Section 3.1 of this policy, please:
- Email your request to info@sahfar.in with your order/invoice details, payment proof, and reason for cancellation.
- Allow our team up to 7–10 business days to review your request and verify whether any work or resource allocation has commenced.
- If approved, refunds will be processed to the original mode of payment within 15–30 business days, subject to bank/payment gateway processing timelines. Applicable transaction and administrative charges may be deducted.
Sahfar reserves the sole right to evaluate and approve or reject refund requests based on the actual project status at the time of the request.
9. GST, Invoicing & Taxes
- All payments are subject to applicable Goods and Services Tax (GST) and other statutory levies as per Indian law, for domestic clients.
- GSTIN: 19ABFCS8066B1Z6
- GST and any other applicable taxes already paid to government authorities are non-refundable, even where a partial refund of the service fee is approved.
- International clients are billed as per applicable export-of-service provisions and any applicable cross-border transaction terms communicated at the time of invoicing.
10. Chargebacks & Payment Disputes
Initiating a chargeback or payment dispute with your bank or payment provider without first raising the issue with Sahfar through the process outlined in Section 8 is considered a breach of this policy and our Terms and Conditions. Sahfar reserves the right to contest such disputes with supporting evidence of work completed and to pursue recovery of any resulting losses, including legal costs.
11. International Clients
For clients outside India:
- All refund terms in this policy apply equally to international engagements.
- Refunds, where approved, will be processed in the original currency/mode of payment, and any currency conversion or international transaction charges will be borne by the client.
- Disputes with international clients that cannot be resolved amicably shall be referred to arbitration as detailed in our Terms and Conditions, with the seat of arbitration in Kolkata, India, and proceedings conducted in English.
12. Governing Law & Jurisdiction
This Refund Policy is governed by the laws of India.
- For domestic (Indian) clients, any disputes arising out of or in connection with this policy shall be subject to the exclusive jurisdiction of the competent courts at Kolkata, West Bengal, India.
- For international clients, disputes shall first be attempted to be resolved through good-faith negotiation, failing which they shall be referred to arbitration as per our Terms and Conditions, with Kolkata, India as the seat of arbitration.
13. Changes to This Policy
Sahfar reserves the right to modify or update this Refund Policy at any time without prior notice, to reflect changes in our business practices, services, or legal requirements. The updated policy will be posted on this page with a revised “Last Updated” date. Continued use of our services after such changes constitutes acceptance of the revised policy.
